New bill looks to lower the 'home alone' age in Illinois (2024)

SPRINGFIELD, Ill. (WICS) — The legal age to leave your child home alone in Illinois could soon drop.

Lawmakers are introducing what they call the “babysitting bill” in an effort to help parents cope with the pandemic.

The laws for latchkey kids in Illinois are among the strictest in the nation.

The age limit for most states is between 8 and 12 years old, if there’s an age limit set at all.

In Illinois, the age is 14.

That means any parent who leaves a child younger than 14 home alone or unattended outside can be found guilty of neglect, though that’s not always enforced.

Rep. Sue Scherer, the sponsor of this bill, says that requirement is unreasonable.

Because of the growing number of exclusions from schools and remote learning, she’s renewing a push to lower the legal age to 12 years old.

"These are families where the parents are trying to work, many of the times the mom and the dad both have a job, they’re juggling weird schedules, and they’re on needles and pins constantly just always worried for the other shoe to drop," Rep. Scherer, D-Decatur, said.

Scherer says the current law is too vague, and many people don’t even know they’re breaking it.

A bill similar to this one passed the Illinois House almost unanimously back in 2019, but it was never called for a vote in the Senate.

Scherer says she hopes to get this bill called and passed through both houses as soon as possible.

The consequences for leaving children unattended depend on how old they are, whether they have special needs, and the length of time they were left alone.
